VIDEO: Police beat 15 year old girl. UPDATE – Deputy fired.

While some police are very good, we need to keep in mind that some are very bad. Incidents like this create a real problem. How is anyone supposed to trust the police with video’s like this being released right and left it seems? How are the good police going to make real progress when others behave like this?

Surveillance video released in an assault case against a King County, Wash., sheriff’s deputy shows a deputy kicking a 15-year-old girl, slamming her to the floor of a jail cell, striking her and pulling her hair.

The footage shows the attack beginning after the girl enters the cell and kicks off one of her shoes toward the deputy.

The video released Friday [02-27-09] is part of an assault case in which Deputy Paul Schene, 31, is accused of using excessive force on the girl, who was being held in a cell at the suburban SeaTac City Hall. Schene, who is charged with fourth-degree assault, pleaded not guilty on Thursday [02-26-09] in Superior Court.

The incident last November began after the girl was brought in for an auto theft investigation, according to court documents.

“We believe this case is beyond just police misconduct, it’s criminal misconduct,” King County Prosecutor Daniel Satterberg said. “This is clearly excessive force.”

Satterberg added the case is uncommon because cameras captured the entire incident.

Schene was investigated previously for shooting two people — killing one — in “the line of duty” in 2002 and 2006. Both times his actions were found to be justified, said Ian Goodhew, prosecutor’s deputy chief of staff.

In the video, a deputy kicks the girl, pushing her back toward the wall. The deputy then strongly backs the girl against the wall, and slams her to the floor by grabbing her hair. A second deputy enters the holding cell, while the first deputy holds the girl face down to the floor. The first deputy appears to hit the girl with his hands. The girl is then lifted up and led out of the cell while the first deputy holds her hair.

The second officer shown in the video was a “trainee” at the time—this means he was a coward who did not stop the crime in progress—and is not under investigation, Goodhew said.

According to court documents, the girl complained of breathing problems after the incident and medics were called to check her. A short time later, she was taken to a youth detention center and booked for investigation of auto theft and third-degree assault, the latter accusation dealing with her conduct toward the deputy. The girl has pleaded not guilty to taking a motor vehicle without permission, Goodhew said Friday, adding she was never formally charged with assault.

Schene told investigators through an e-mail conversation with his lawyer that once he was assaulted by the girl kicking her shoe at him, he entered the cell to “prevent another assault,” according to court documents. Schene also said that the girl failed to comply with instructions in the holding area.

Federal prosecutors have launched a civil rights investigation of a King County sheriff’s deputy who was shown on a videotape beating a 15-year-old girl in a holding cell after she kicked a tennis shoe at his legs.

Assistant U.S. Attorney Kelly Harris said the release Friday of a video that shows the November beating prompted prosecutors to launch the inquiry. “It (the video) definitely drives home the fact that we need to look at it,” he said.

The video shows Deputy Paul Schene rushing into the cell and slamming Malika Calhoun against the wall, throwing her facedown to the floor and punching her before lifting her to her feet by her hair and leading her out of the cell.

If Schene is prosecuted and found guilty of depriving Calhoun of her civil rights while acting in his official capacity, he could face up to five years in prison and a $250,000 fine, Harris said.

Schene and a rookie deputy who was present during the beating, Travis Brunner, asserted in a report that the tennis shoe — seen in the video flying off the girl’s foot — struck Schene’s shin and caused “bruising, bleeding and pain.” They sought third-degree assault charges against the teenager.

Instead Schene, 31, is facing a misdemeanor assault charge and is on administrative leave. He pleaded not guilty to the charge. The Sheriff’s Office is conducting an internal investigation of the incident, which could result in disciplinary actions separate from any criminal sanctions.

Harris wouldn’t comment on whether Brunner also is the subject of the federal civil rights investigation.

Calhoun was arrested in November on an auto theft charge, which is being processed in King County Juvenile Court.

FBI Special Agent Robbie Burroughs said the bureau has opened a preliminary inquiry into the incident. “We will gather the basic facts of the incident and forward it to the Civil Rights Division of the Department of Justice,” she said.

Schene is among more than a half-dozen King County sheriff’s deputies who have been federally investigated for excessive force and other issues in recent years. Several of those inquiries were opened after the Seattle P-I exposed details about misconduct allegations against the officers. Across the country, the FBI has pursued fewer such investigations of alleged police wrongdoing because the Bush administration transferred thousands of agents to counterterrorism duties.

Recent investigations against the Sherriff’s Office include:

Civil rights and perjury allegations against Deputy Brian Bonnar. In late 2008, a federal jury acquitted Bonnar of civil rights violations and four counts of perjury after a woman he arrested and several fellow officers accused him of using excessive force during a 2005 arrest. His indictment represented the first time in well over a decade that a federal grand jury had brought charges against an officer for such “color of law” violations.

Allegations of civil rights violations against Denny Gulla: In 2004, Gulla, a 23-year veteran and the subject of a number of misconduct accusations, drew a federal inquiry when he pulled over the husband of his lover on a bogus traffic stop and threatened to kill him. Despite a recommendation from an FBI supervisor that the case go forward, the U.S. Department of Justice Civil Rights Division declined to prosecute, saying Gulla already had been punished administratively by superiors.

Dan Ring: The former intelligence detective, who cut a deal with the King County sheriff and prosecutors that allowed him to escape state prosecution for a felony charge and three misdemeanors, drew an investigation by the U.S. Attorney’s Office and the FBI after the P-I exposed details about his case. Federal authorities said they were examining whether federal criminal charges should have been filed against Ring; as of Tuesday, none had been.

Civil rights violations accusations against Joseph Abreu III, Bruce Matthews and Garrett Jorgensen: In February 2002, Sherry Reynolds, a software consultant and former volunteer firefighter, filed a formal complaint against three officers, whom she witnessed violently handle a homeless man outside a grocery store. After she filed the complaint, Reynolds was charged with obstruction of justice. The FBI opened a preliminary investigation into the deputies. Local agents felt they had a strong case, but the Department of Justice declined to prosecute.

SEATTLE — A King County Sheriff’s deputy who was seen on video beating a teenage girl in a holding cell has been fired, officials said Monday.

Sheriff spokesman John Urquhart said Paul Schene was fired for a number of policy violations, including the incident captured on video.

Urquhart said Schene pleaded his case before Sheriff Sue Rahr on September 9, but she found the violations to be supported and agreed with the recommendation that Schene be fired.

The department violations included making false statements, conduct that is criminal in nature, excessive or unnecessary force and discrimination in civility or bigotry, among others, Urquhart said.

Beck Goes Ballistic & Obama’s Numbers Don’t Add Up – There aren’t enough taxpayers.

See the little wall of text below, it took the income from the top 2% of wage earners as Obama suggested and see how much money would be raised by upping their income tax rate to 39.6% as proposed.

2006 was a very good year for the economy and that 2% paid %522 billion which is far short of what Obama says will come in.

Now the economy is a mess, and by raising the tax rates those people (and small businesses) will invest less, and try to keep money where it will not be taxed, so raising the rate will not bring in as much revenue as the static model says. This will also raise prices which makes sure people buy less, which causes more unemployment and less taxes.

This is why you do NOT raise taxes in a recession, especially on the evil rich who you are counting on to move some money to get the economy rolling.

But hey, if we took every penny from the top 2% of tax filers…..well here, Glenn Beck has a tax expert who will explain it to you….

[Obama proposed that we] end “tax breaks for the wealthiest 2% of Americans,” and he promised that households earning less than $250,000 won’t see their taxes increased by “one single dime.”This is going to be some trick. Even the most basic inspection of the IRS income tax statistics shows that raising taxes on the salaries, dividends and capital gains of those making more than $250,000 can’t possibly raise enough revenue to fund Mr. Obama’s new spending ambitions.

Consider the IRS data for 2006, the most recent year that such tax data are available and a good year for the economy and “the wealthiest 2%.” Roughly 3.8 million filers had adjusted gross incomes above $200,000 in 2006. (That’s about 7% of all returns; the data aren’t broken down at the $250,000 point.) These people paid about $522 billion in income taxes, or roughly 62% of all federal individual income receipts. The richest 1% — about 1.65 million filers making above $388,806 — paid some $408 billion, or 39.9% of all income tax revenues, while earning about 22% of all reported U.S. income.

Note that federal income taxes are already “progressive” with a 35% top marginal rate, and that Mr. Obama is (so far) proposing to raise it only to 39.6%, plus another two percentage points in hidden deduction phase-outs. He’d also raise capital gains and dividend rates, but those both yield far less revenue than the income tax. These combined increases won’t come close to raising the hundreds of billions of dollars in revenue that Mr. Obama is going to need.

Obama to Seek New Assault Weapons Ban
Previous Ban Expired in 2004 During the Bush Administration
WASHINGTON, Feb. 25, 2009-

The Obama administration will seek to reinstate the assault weapons ban that expired in 2004 during the Bush administration, Attorney General Eric Holder said today.

“As President Obama indicated during the campaign, there are just a few gun-related changes that we would like to make, and among them would be to reinstitute the ban on the sale of assault weapons,” Holder told reporters.

Holder said that putting the ban back in place would not only be a positive move by the United States, it would help cut down on the flow of guns going across the border into Mexico, which is struggling with heavy violence among drug cartels along the border.

“I think that will have a positive impact in Mexico, at a minimum.” Holder said at a news conference on the arrest of more than 700 people in a drug enforcement crackdown on Mexican drug cartels operating in the U.S.

Mexican government officials have complained that the availability of sophisticated guns from the United States have emboldened drug traffickers to fight over access routes into the U.S.

A State Department travel warning issued Feb. 20, 2009, reflected government concerns about the violence.

“Some recent Mexican army and police confrontations with drug cartels have resembled small-unit combat, with cartels employing automatic weapons and grenades,” the warning said. “Large firefights have taken place in many towns and cities across Mexico, but most recently in northern Mexico, including Tijuana, Chihuahua City and Ciudad Juarez.”

At the news conference today, Holder described his discussions with his Mexican counterpart about the recent spike in violence.

“I met yesterday with Attorney General Medina Mora of Mexico, and we discussed the unprecedented levels of violence his country is facing because of their enforcement efforts,” he said.

Now here is where the lies come in and its the same as the old lie.

The weapons they are calling “assault weapons” and want to ban are not the low to medium powered, selective fire, automatic weapons see on TV. They are NOT machine guns. Yet those who want to take away your ability to defend your freedom with effective means always TALK about machine guns, and machine guns are what they show on the news when they talk about this, but the guns they want to ban fire ONE bullet with each pull of the trigger and are functionally no different from a 1911 Colt .45. These guns LOOK like assault rifles but they lack assault rifle functionality.

It says in the article that the drug cartels in Mexico have automatic weapons, that means machine guns. American gun stores don’t sell machine guns. That’s right folks, it’s the old bait & switch.

The last time the Democrats did this they got creamed come election time. Bush dared the Democrats to pass it and threatened to sign it knowing that the Democrats would get the blame. Rank and file union members have shown that they will vote Republican in a heartbeat over this issue.

This is why Nancy Pelosi told Eric Holder NO WAY.

Obama talked over and over how he supported the Heller decision (granted he flip flopped on it but he did say it) and opposed gun bans. No one who supports the Heller decision by the Supreme Court could possibly support any kind of ban of this kind.

A New Assault Weapons Ban Will Not Reduce Crime In This Country

It is pretty hard to seriously argue that a new so-called “assault weapons” ban would reduce crime in the United States. Even research done for the Clinton Administration couldn’t find that the federal assault weapons ban reduced crime.

There are no academic studies by economists or criminologist that find the original federal assault weapons ban reduced murder or violent crime generally. There is no evidence that the state assault weapons bans reduced murder or violent crime rates –and there’s even some evidence that they may have caused murder to actually rise slightly. Since the federal ban expired in September 2004, murder –and overall violent crime rates– have remained virtually unchanged.

If Holder thinks that it is so easy to control drug gangs’ access to guns, one way to show it is by proving that he can stop drug gangs’ access to drugs.

In fact, when the assault weapons ban went off into the sunset in September 2004 there was no explosion of murder and bloodshed as gun control advocates feared. Immediately after the law expired murder rates fell and they fell more in the states without state assault weapon bans than the states with them.

VP of College Democrats in New Jersey Tried to Attack Ann Coulter and….

His name is Mike Tracey and he is the VP of the College Democrats at TCNJ. He tried to rush the stage where Ann was signing books….he didn’t quite make it that far.

The police report from that night says that Tracey went onto the stage, where Coulter was signing books.

After being advised the stage area was for those with books only, Tracey said he had a piece of paper and wanted an autograph.
“When he was told no, he went around two police officers and approached the table where Ann Coulter was sitting,” Holt wrote.

Holt took Tracey off the stage and into the seating area, then told the student he was not allowed to go back to the stage and had to leave.

As Tracey walked back towards the stage, Holt grabbed Tracey’s coat in an attempt to stop him, but said Tracey spun out of the coat and ran towards the seating area.

Tackling Tracey toward the ground, Holt attempted to handcuff Tracey, but the young man would not put his hands behind his back.

“At that point Michael started to scream and carry on in a manner in which he was trying to draw attention from the crowd,” Holt wrote. “

The Congress is passing a spending bill packed with thousands of earmarks and other pork. While Republicans did not propose the majority of these earmarks, a healthy percentage of them did.

While not all earmarks mean corruption, the earmark process invites corruption and special interest chicanery.

You told Glenn Beck that it was time for you to get in people’s face if they are harming the Republican brand.

Any Republicans who are voting for this bill are harming the Republican brand. The editor of this web site supported your candidacy. You have talked the talk, now it is time to walk the walk.

How to Defeat James Carville’s Two Best Talking Points

I have seen Democrat Strategist James Carville on the cable news shows and he always says two things, both of which are a complete deception.

The first Carville talking point is :

Rush Limbaugh, the head of your party, says that he wants this president to fail so you rotten Republicans are just trying to block for the sake of blocking. Your opposition isn’t sincere. You are so afraid of Limbaugh that you won’t applaud for Obama even when you agree with him.

Republicans have to be bold with the facts here and hit back hard:

WRONG! Limbaugh said that if Obama wants to socialize America and turn America into what looks like a failed European socialist state then he wants him to fail.

We Republicans want America to win and we aren’t going to win with these bloated government policies that resemble Jimmy Carter and Herbert Hoover. I happened to know that in spite of your differences you and Rush are friends through your wife so there is no excuse for you to not tell the truth about his message. Or Mine.

And excuse me Jim, Ok lets talk about support. Do you mean support for Obama like the Democrats gave President Bush, or the war, or trying to keep another attack from happening on our soil? Democrats didn’t dare utter the word Victory in regards to the war effort, instead the Democratic leader was too busy giving the enemy a propaganda coup by declaring the war lost just as the surge was about to become a total success.

Are you questioning my patriotism James? Didn’t you say that dissent is the highest form of Patriotism?

Carville will immediately jump into his second talking point:

We Democrats don’t need lectures from Republicans about big spending and fiscal irresponsibility we have the last eight years to demonstrate that.

The proper response:

Excuse me Jim but Democrats were spending too much gleefully right along with the Republicans the voters threw out of office and now instead of the change that YOU promised, you are taking what went wrong in the last 8 years, doing it again, and putting in on steroids.

You know it, the CBO knows it, the 100 economists who put an ad in the New York Post know it, the CNBC talking heads know it and the market knows it which is why it tanks every time Obama gets in front of a microphone.

These responses also have the virtue of being true.

It reminds me of Quinn’s law # 2 , “If you want to know what leftists are up to, pay attention to what they accuse the conservatives of.”

It’s those tax cuts that got us into this mess.

The proper response:

Excuse me James, but before Bush took office we had another bubble that bursted, trashed the economy, and caused a recession; it was called the tech Bubble, and then 9/11 hit us. So we lowered taxes on everyone and got out of the way. The economy recovered, unemployment went down and government revenue went up and lowered the deficit. So don’t try to lie to the American people they know better.

There is silly, there is stupid and then there is royally pathetic. The question is, what category does this fall into?

There is a reason why one should never use Wikipedia as a source for ANYTHING.

It is well known that Wikipedia has a controversies section on many subjects, institutions and people. But for IUSB that section is no longer and that is not the only thing that is missing. They also like to remove parts of the other sections such as links to student publications and other activities.

A few people here at IUSB, whose IP’s can be tracked easily to identify the perpetrators, have been whitewashing IUSB’s wikipedia entry.

So the question is, are you prepetrators going to start obeying the spirit of Wikipedia’s rules or shall we publish your names at the top of this very page, with a nice fat picture to go with the name? Anything really worth doing is worth doing in the light of day is it not?

UPDATE – So I started parusing around the history of the page. Take a look HERE. The controversies section as added by someone and it is removed.  This is just one example. The factbook link to IUSB is gone, links to the Preface, the Vision, and information about the SAC and housing and other things. Even information on student clubs went POOF and so did links and references to things in the South Bend Tribune about IUSB.

It is no secret that PR people monitor the pages they work for like a hawk. These people abuse and manipulate the rules and try to make relationships with official Wikipedia editors to go after people who would post any relavent fact they find inconvenient. By manipulating these rules people submit for banning anyone who posts information that is not liked.

Congressional staffers monitor wikipedia like hawks, and there are even guides on how to use and manipulate wikipedia to use it for marketing (1, 2, 3, 4, 5, 6).

Wikipedia was designed to be the “anti-corporate”, collectivist open source, feel good, kumbaya, place to get “real” information that was “honest”.  The new rules and tools they implemented to resist corprate PR take over of Wikipedia made the editing rules and tools more complex thus allowing those who have taken the time to master a complex new “edit verifying system” to manipulate it and actually strengthen the PR lock on Wikipedia’s content.

The result: Since Wikipedia results are often near the top of any Google search, the “anti-corporate” information source has become THE public relations marketing tool of the internet (see Quinn’s Laws of Leftism #1).

Always remember that nothing on wikipedia should be accepted as anything but total PR marketing and has no more credibility than a cigarette ad in a magazine.

UPDATE II – One of our people tried to reinsert some of the links that had been removed from the site, within 90 seconds they were removed and a warning from Wikipedia about posting spam and warez was given to the poster. Of course there was no spam or warez, just a couple of links that were there for a long time and then whitewashed.

CBO: Obama’s Deficit Reduction Plan Unlikely to Work and…..

…The latest CBO deficit estimates do not include the costly policy initiatives in health care, energy and education that the president mentioned in his Tuesday speech before a joint session of Congress.

Smart people know that the CBO uses static models so their predictions on revenue are often off because they do not account for how changes in policy affect peoples behavior. For Example: when the capital gains tax was lowered CBO predicted that the revenue from the tax would fall when in fact it went up.

Here is the rub, Democrats use these kind of numbers and even though they rarely pan out, they continue to believe in them, so this means that they are doing this in spite of numbers they trust telling them it is not going to happen (see Quinn’s Law #5).

Washington Times:

A new report reveals how difficult it will be for President Obama to increase spending on health care, energy and education while cutting the deficit in half.

Based on budget scenarios outlined by House Speaker Nancy Pelosi, California Democrat, federal budget deficits will average $870 billion for the next 10 years, according to a new analysis by the nonpartisan Congressional Budget Office (CBO).

FACT CHECK: Obama’s words on home aid ring hollow

WASHINGTON (AP) – President Barack Obama knows Americans are unhappy that the government could rescue people who bought mansions beyond their means.

But his assurance Tuesday night that only the deserving will get help rang hollow.

Even officials in his administration, many supporters of the plan in Congress and the Federal Reserve chairman expect some of that money will go to people who used lousy judgment.

The president skipped over several complex economic circumstances in his speech to Congress – and may have started an international debate among trivia lovers and auto buffs over what country invented the car.

A look at some of his assertions:

OBAMA: “We have launched a housing plan that will help responsible families facing the threat of foreclosure lower their monthly payments and refinance their mortgages. It’s a plan that won’t help speculators or that neighbor down the street who bought a house he could never hope to afford, but it will help millions of Americans who are struggling with declining home values.”

THE FACTS: If the administration has come up with a way to ensure money only goes to those who got in honest trouble, it hasn’t said so.

Defending the program Tuesday at a Senate hearing, Federal Reserve Chairman Ben Bernanke said it’s important to save those who made bad calls, for the greater good. He likened it to calling the fire department to put out a blaze caused by someone smoking in bed.

“I think the smart way to deal with a situation like that is to put out the fire, save him from his own consequences of his own action but then, going forward, enact penalties and set tougher rules about smoking in bed.”

Similarly, the head of the Federal Deposit Insurance Corp. suggested this month it’s not likely aid will be denied to all homeowners who overstated their income or assets to get a mortgage they couldn’t afford.

“I think it’s just simply impractical to try to do a forensic analysis of each and every one of these delinquent loans,” Sheila Bair told National Public Radio.

OBAMA: “And I believe the nation that invented the automobile cannot walk away from it.”

THE FACTS: Depends what your definition of automobiles, is. According to the Library of Congress, the inventor of the first true automobile was probably Germany’s Karl Benz, who created the first auto powered by an internal combustion gasoline engine, in 1885 or 1886. In the U.S., Charles Duryea tested what library researchers called the first successful gas-powered car in 1893. Nobody disputes that Henry Ford created the first assembly line that made cars affordable.

OBAMA: “We have known for decades that our survival depends on finding new sources of energy. Yet we import more oil today than ever before.”

THE FACTS: Oil imports peaked in 2005 at just over 5 billion barrels, and have been declining slightly since. The figure in 2007 was 4.9 billion barrels, or about 58 percent of total consumption. The nation is on pace this year to import 4.7 billion barrels, and government projections are for imports to hold steady or decrease a bit over the next two decades.

OBAMA: “We have already identified $2 trillion in savings over the next decade.”

THE FACTS: Although 10-year projections are common in government, they don’t mean much. And at times, they are a way for a president to pass on the most painful steps to his successor, by putting off big tax increases or spending cuts until someone else is in the White House.

Obama only has a real say on spending during the four years of his term. He may not be president after that and he certainly won’t be 10 years from now.

OBAMA: “Regulations were gutted for the sake of a quick profit at the expense of a healthy market. People bought homes they knew they couldn’t afford from banks and lenders who pushed those bad loans anyway. And all the while, critical debates and difficult decisions were put off for some other time on some other day.”

THE FACTS: This may be so, but it isn’t only Republicans who pushed for deregulation of the financial industries. The Clinton administration championed an easing of banking regulations, including legislation that ended the barrier between regular banks and Wall Street banks. That led to a deregulation that kept regular banks under tight federal regulation but extended lax regulation of Wall Street banks. Clinton Treasury Secretary Robert Rubin, later an economic adviser to candidate Obama, was in the forefront in pushing for this deregulation.

OBAMA: “In this budget, we will end education programs that don’t work and end direct payments to large agribusinesses that don’t need them. We’ll eliminate the no-bid contracts that have wasted billions in Iraq, and reform our defense budget so that we’re not paying for Cold War-era weapons systems we don’t use. We will root out the waste, fraud and abuse in our Medicare program that doesn’t make our seniors any healthier, and we will restore a sense of fairness and balance to our tax code by finally ending the tax breaks for corporations that ship our jobs overseas.”

THE FACTS: First, his budget does not accomplish any of that. It only proposes those steps. That’s all a president can do, because control over spending rests with Congress. Obama’s proposals here are a wish list and some items, including corporate tax increases and cuts in agricultural aid, will be a tough sale in Congress.

Second, waste, fraud and abuse are routinely targeted by presidents who later find that the savings realized seldom amount to significant sums. Programs that a president might consider wasteful have staunch defenders in Congress who have fought off similar efforts in the past.

OBAMA: “Thanks to our recovery plan, we will double this nation’s supply of renewable energy in the next three years.”

THE FACTS: While the president’s stimulus package includes billions in aid for renewable energy and conservation, his goal is unlikely to be achieved through the recovery plan alone.

In 2007, the U.S. produced 8.4 percent of its electricity from renewable sources, including hydroelectric dams, solar panels and windmills. Under the status quo, the Energy Department says, it will take more than two decades to boost that figure to 12.5 percent.

If Obama is to achieve his much more ambitious goal, Congress would need to mandate it. That is the thrust of an energy bill that is expected to be introduced in coming weeks.

OBAMA: “Over the next two years, this plan will save or create 3.5 million jobs.”

THE FACTS: This is a recurrent Obama formulation. But job creation projections are uncertain even in stable times, and some of the economists relied on by Obama in making his forecast acknowledge a great deal of uncertainty in their numbers.

The president’s own economists, in a report prepared last month, stated, “It should be understood that all of the estimates presented in this memo are subject to significant margins of error.”

Beyond that, it’s unlikely the nation will ever know how many jobs are saved as a result of the stimulus. While it’s clear when jobs are abolished, there’s no economic gauge that tracks job preservation. The estimates are based on economic assumptions of how many jobs would be lost without the stimulus.

Senator Byrd:

Sen. Robert Byrd (D-W.Va.), the longest-serving Democratic senator, is criticizing President Obama’s appointment of White House “czars” to oversee federal policy, saying these executive positions amount to a power grab by the executive branch.

In a letter to Obama on Wednesday, Byrd complained about Obama’s decision to create White House offices on health reform, urban affairs policy, and energy and climate change. Byrd said such positions “can threaten the Constitutional system of checks and balances. At the worst, White House staff have taken direction and control of programmatic areas that are the statutory responsibility of Senate-confirmed officials.”

While it’s rare for Byrd to criticize a president in his own party, Byrd is a stern constitutional scholar who has always stood up for the legislative branch in its role in checking the power of the White House. Byrd no longer holds the powerful Appropriations chairmanship, so his criticism does not carry as much weight these days. Byrd repeatedly clashed with the Bush administration over executive power, and it appears that he’s not limiting his criticism to Republican administrations.

Byrd also wants Obama to limit claims of executive privilege while also ensuring that the White House czars don’t have authority over Cabinet officers confirmed by the Senate.

Tennessee may reject stimulus aid for jobless:

Tennessee could reject a portion of the $787 billion economic stimulus package out of concerns that it would force the state to raise taxes on businesses in the future.

At the National Governors Association meetings in Washington, D.C., Gov. Phil Bredesen said this week that he might turn down relief for unemployed workers worth an estimated $143 million because of conditions placed on the money by Congress.

The stimulus package would also raise unemployment benefits by $25 a week for all workers, but in addition, lawmakers want states to expand the pool of people who can apply for benefits. That would put more pressure on an unemployment trust fund that is already trying to stave off insolvency.

Editor’s reaction to the speech – Open letter to President Obama.

Mr. President,

It was a great speech you made to Congress as it contained goals that every American can get behind. Understanding that America is a center-right nation you even managed to couch your plans using conservative rhetoric.

The problem is the legislation that you and the Democrats are proposing/have proposed does not do enough to empower regular folks; rather it empowers government and special interest constituent groups that will kick back millions to the Democratic Party.

You have reneged on your repeated pledges of transparency (1, 2, 3, 4, 5,) and several other issues.

You bragged that your stimulus bill had no “earmarks” yet your own Senator Schumer has stated that the stimulus bill was filled with “porky amendments”. The AP, whose coverage was very sympathetic to your candidacy, has said that you are being deceptive.

To pay for some of that pork a much-needed tax break for home buyers was dropped from the bill. While there are some good things in the bill like the American Opportunity Tax Credit that is intended to give a tax break to working families who have a family member going back to college I am very concerned that for the expense, there is not enough good and too much of the old politics as usual.

You promised to put legislation up on the internet for 2-5 days before it is voted on. Starting with bill number one (HR1) that promise was broken. You promised a new era of bipartisanship and then locked Republicans out of the bill negotiations. The final version only came out a few hours before the vote, but your lobbyist special interest friends got copies of the “porky”, special interest lined stimulus bill before most members of Congress even saw the final version.

You talk about individual and government responsibility yet snuck in language to reverse the hugely successful welfare reform program to the stimulus without telling anyone.

Your wife Michelle criticized one of the Bush tax cuts because it returned $600 to the taxpayer. The tax cut (or more accurately stated “your tax deduction table modification” as the tax rate was never changed) you bragged about that was in the “porky” stimulus bill averages out to $13 a week, which totals $676.

According the analysts from Bloomberg, Fox, universities, and even NBC (1, 2, 3,),  who has been in the tank for you more than any other media outlet, your stimulus program does not do much to create jobs and will cost well over $200,000 per job it does create. Some of these same analysts say that your mortgage plan is wrong-headed, isn’t comprehensive, and mostly supports the few who are the least deserving of help.

You keep saying that Republicans want to do nothing when you know that every Republican in the Senate voted for an alternative bill that was so good when it was ran through the economic model that YOUR administration uses it created twice the jobs with half the money.

You talk about improving education, but not only did you pick a Secretary of Education who is not addressing the real issues in education, your party is proposing legislation to ban the school voucher program in Washington  DC which has been saving inner city kids from public schools that have failed them utterly. Apparently voucher programs aren’t very effective at tossing money to teachers unions, however, they are effective at giving inner city kids a fighting chance to succeed. That same bill has $410 billion in more big government spending with thousands of earmarks which we all learned from the campaign are a part of an appropriations process that is often corrupted and abused. Didn’t you say in the campaign that you would go through these kinds of bills line by line?

You hold a “Fiscal Responsibility Summit” and special interests were all over it. You have appointed lobbyists all over your administration after promising not to (1, 2, 3).

The tax hike idea that you brag “will only impact those who make over $250,000” will largely impact small to medium-sized business “S-Corporations” which will kill jobs, raise prices, and push more small to medium-sized domestic competition out of the competition. In the mean time the genuine super rich will hardly notice the difference.  The “super rich” like John Kerry and other mega millionaires/billionaires make money in many ways that are not considered “earned income” and enjoy countless favors in a tax-code making it so thick it is measured in feet. For example: John Kerry made $5,072,000 in 2003 and had a total federal tax burden of 12.34%. You know as well as I that those like the Kerry’s will NOT be paying a genuine 39.6% rate as you plan to force productive wage earners and small business to pay (see Norton’s First Law).

While the government is/and is about to send trillions of dollars to Wall Street (2), since 2005 you have taken more money from Wall Street, Fannie Mae and the defunct Lehman Brothers (2, 3) than anyone.

The word disappointed hardly covers it.

Cramer and Morici – Why the Stimulus and Obama’s Mortgage Plan Won’t Work.

UPDATE March 2011 – Cramer said that a plan had a chance at working if there is a system to help the toxic assets with mortgage holders and the banks. It didn’t happen so the hope he mentioned has been dashed. At 2:30 Cramer starts talking about what Obama should have done with the banking plan. Cramer nailed it, why Obama didn’t do this….. well Dick Morris understands why. Look him up in our “Mortgage Crisis” category.

Jim Cramer and University of Maryland economist Pete Morici explain why the stimulus plan wont create many jobs and why Obama’s Mortgage Plan takes the wrong approach and wont help the housing market. Jim Cramer is one of the people who was talking about this crisis pretty far in advance.

Essentially Rick Santelli is right that the plan needs to help all Americans not just constituent groups who got subprimes that they had no chance of ever paying off  or rich borrowers who got caught while trying to “flip” multiple houses. See What Rick has to say HERE, it is essentially the same thing that Jim Cramer and Dr. Morici are saying in the video above. It is also what we at IUSB Vision have been saying since Feburary 3rd.

There are also some lenders who had balloon payments or a balloon interest rate in some loans guaranteeing that the buyer would default. Those lenders should be prosecuted.

Santelli, Cramer, Mirici and IUSB Vision are not alone in our thinking.

Mortgage Plan Aids Liars About Income, Amherst Says

Feb. 20 (Bloomberg) — The Obama administration’s mortgage- modification plan offers the most aid to homeowners who “really stretched to buy their house and lied the most about their income,” Amherst Securities Group LP analysts said.

The plan calls for government payments before and after loans are reworked to mortgage servicers and lenders including mortgage-securities investors, as well as borrowers, Amherst’s Laurie Goodman and Roger Ashworth wrote in a report today. The proposal also will “badly misalign” the incentives of servicers and bondholders, they wrote.

“This program needs to be retooled,” the New York-based mortgage-bond analysts wrote. Amherst is a securities firm specializing in trading and advising investors on home-loan debt.

Under Obama’s plan, a borrower who qualified for a 6 percent interest-only “stated income” loan of $250,000 by claiming income of $45,000 a year while actually making $37,500 would see payments cut by $2,625 annually through lender and government subsidies, according to their report. A borrower who actually made $30,000 while claiming to make $45,000 would pay $5,700 less a year to meet the debt-to-income ratios sought.

“The borrowers that really stretched to buy their house and lied the most about their income receive the largest break in payments,” the analysts wrote.

This is why Santelli had a cow on the air and did his rant. Those who cheated on the bottom end and on the top end will benefit the most, those of us who cut back and struggled to barely keep up with mortgage payment’s get the shaft.

Free Speech Coming to an End in Europe (unless your an islamic radical)

This is Geert Wilders. He is a Member of Parliament in the Netherlands. He has been banned from the UK and is being prosecuted in his home country for “hate speech”. His crime is quoting islamists and others such as Winston Churchill about radical Islam. Now those who said the things originally are fine, but dare to quote them and they throw the book at you.

The fact that these crosses remained displayed in the College Democrats’ office for over 24 hours just adds to the sheer lack of respect they have for Christians on campus.”

Back in October, The Washington Times reported on allegations of an ominous and potentially dangerous atmosphere of hostility and intolerance for campus Conservatives, free speech, and apparently now, Christianity, by the George Washington University chapter of the national College Democrats organization. Here’s an excerpt from the article:

“College conservatives say the excitement of a historic presidential election which could send the first black American to the White House has become clouded by an atmosphere of intimidation and hostility on campus.

“People on campus who say they’re the most tolerant, they simply do not walk the walk,” said Brand Kroeger, chairman of the George Washington University College Republicans and head of the D.C. Federation of College Republicans.

Mr. Kroeger said he has been flooded with calls from students who feel they cannot express their views in favor of Republicans for fear of being shouted down….

GW College Democrats President Cory Struble was accused of sanctioning harassment of Republican and conservative students with comments he made at the beginning of the semester WRGW Radio.

According to an audio file provided by Mr. Struble, he said, “We seek to marginalize them as much as possible. You remember YAF last year put an ad in the paper saying how marginalized they felt [at GW]. Well, this year we want to make sure that GW is an even more uncomfortable environment for Republicans and conservatives…”

Today’s story is breaking and developing. Here are the initial details as revealed to me by two confidential sources within the College Republicans. I have no official statement or comment yet from the organization.

The College Republicans were in possession of a number of crucifixes used in a University-sanctioned Right To Life display. When the display was taken down, they were stored in the College Repulicans’ side of their shared but divided office space with the College Democrats. When the last College Republican members left the offices this last Friday, January 23, the crucifixes were safely stored on their side of the suite.

This Monday afternoon, January 27, when the first College Republicans to re-enter the offices did so, they discovered some of the horrifically desecrated crucifixes, stolen from the private property confines of their storage containers, and proudly displayed on the College Democrats’ bulletin board, and other areas, including a bowl, laid out as if they were candy for any member of the public who visited the office to take home and enjoy. One crucifix featured the College Democrats’ version of Christ: a large penis with an actual condom pulled over the top, in lieu of His crown of thorns.

Feb. 23 (Bloomberg) — The U.S. embargo on Cuba would be loosened, regulatory agencies would get budget increases and lawmakers would secure money for thousands of pet projects known as earmarks under a proposed $410 billion spending bill.

House Speaker Nancy Pelosi, a California Democrat, called the new bill “the unfinished business of last year when the president refused to address the priorities and the needs of the American people.” 

Wow – how is that for your basic Orwellian propaganda sound bite??

The measure was released as President Barack Obama pledged at a budget summit to cut the government’s yearly budget deficit in half in four years. The White House and Congressional Budget Office forecast the deficit for this fiscal year will be at least $1.3 trillion.

 The measure would boost the budgets for regulatory agencies Democrats have said were inadequately funded during the Bush years. The bill would provide the Consumer Product Safety Commission with $105 million, a 31 percent increase from last year. The Commodity Futures Trading Commission’s budget would also grow by 31 percent, to $146 million

Can you imagine trying to live without a 31% budget increase in these bureaucracies?? It goes right along with your 31% budget increase right???

The Food and Drug Administration’s budget would grow 19 percent, to $2 billion. The Occupational Safety and Health Administration would get $513 million, a 6 percent increase. The Securities and Exchange Commission would get a 4 percent increase, to $943 million.

Did you know that the interest on the debt is now greater than the cost of the entire Iraq War?

Another provision would end a school-voucher program in Washington D.C. after the 2009-2010 school year. That proposal sparked criticism from House Minority Leader John Boehner, an Ohio Republican. In a statement, he said the school-choice program “has provided hope for thousands of low-income children in the District of Columbia” and that eliminating it “would represent an irresponsible and shameful act” by Democrats.

And here we have the pay to play corruption. If inner city black parents use those vouchers to get their children out of unsafe and failing inner city schools, how will the teachers union be able to kick back millions of dollars back to the Democratic Party? Obama is half black, do you think that he will stick up for these kids or do you think that he will continue to politicize and undermine public education as he did when he worked for Bill Ayers by misusing Annenberg Charity funds to run programs to show teachers how to radicalize their students? UPDATE – They took the money from the inner city black kids to go to a school that isn’t a failure and passed 9,000 pork earmarks…

Ethics You Can’t Believe In: Special Interests Dominate Fiscal Responsibility Summit

Study after study has shown that if you lobby Congress and spread the money around you get a disproportionate share of legislative and monetary favors from the government. So who is advocating for you or more importantly, who is advocating against you? Obama and the Democrats promised an end to this kinda stuff…..

Policy insiders and Washington special interests dominated the talk at the Fiscal Responsibility Summit at the White House on Monday. So much for keeping the special interests at bay.

For all the talk about reforming government, the bulk of the guests at Monday’s Fiscal Responsibility Summit are from groups with clear investments in the Obama administration.

Aside from the 64 representatives from the Obama administration and Congress, a sampling of the 56 “community leaders and stakeholders” shows that no less than seven union chiefs, 10 organizations advancing racial and ethnic concerns, 10 progressive think tanks and advocacy groups, three universities, three health care associations and at least six interests groups for women, seniors, disabled and gay rights groups were in attendance.

Six conservative think tanks and advocacy groups, two health policy organizations and four business associations along with one law firm specializing in Wall Street mergers, one retirement and financial services fund, a John McCain adviser and a representative from the Congressional Budget Office rounded out the guest list.

Is Obama TRYING to trash our economy?? Plans to raise taxes on small business.

In previous posts we have explained how President Hoover tried to tax and spend and protectionist his way out of a recession that became the Great Depression. Then we explained how FDR and the New Deal continued many of those policies and the result was that unemployment never dropped below 20% until World War II an FDR’s own Treasury Secretary explained how the policy was a failure.

Now Obama wants to raise income taxes and capital gains taxes. Folks, this is a disaster in the making. It is a disincentive for people to invest and it will lower the amount of revenue that will come into the government.

The Obama spin will be that this is just on “the rich”. This is a lie. The tax will hit high wage earners but there aren’t that many of them. The vast majority of those who will be hit by this are Sub. S Corporations. Sub S. Corporations pay the top marginal rate rather than the corporate income tax rate because they are small businesses. Small business does most of the buying and selling and they create 75% of the jobs in this country.

What about the rich? The “rich” like John Kerry and other hyper millionaires/billionaires make money in many ways that are not considered “earned income”. For example: John Kerry made $5,072,000 in 2003 and had a total federal tax burden of 12.34% (See Norton’s First Law).

American small and medium sized businesses pays ridiculously high taxes now and far more than most of the industrialized world. Now Obama wants them to pay 40%. This is a perscription for more unemployment and higher prices for all of us.

To get there, Obama proposes to cut spending and raise taxes. The savings would come primarily from “winding down the war” in Iraq, a senior administration official said. The budget assumes continued spending on “overseas military contingency operations” throughout Obama’s presidency, the official said, but that number is lower than the nearly $190 billion budgeted for Iraq and Afghanistan last year.

Obama also seeks to increase tax collections, mainly by making good on his promise to eliminate some of the temporary tax cuts enacted in 2001 and 2003. While the budget would keep the breaks that benefit middle-income families, it would eliminate them for wealthy taxpayers, defined as families earning more than $250,000 a year. Those tax breaks would be permitted to expire on schedule in 2011. That means the top tax rate would rise from 35 percent to 39.6 percent, the tax on capital gains would jump to 20 percent from 15 percent for wealthy filers and the tax on estates worth more than $3.5 million would be maintained at the current rate of 45 percent.

Obama also proposes “a fairly aggressive effort on tax enforcement” that would target corporate loopholes, the official said. And Obama’s budget seeks to tax the earnings of hedge fund managers as normal income rather than at the lower 15 percent capital gains rate.

Remember the phrase “selected not elected” and how the left always applied that to President Bush? But we don’t hear that phrase any more do we? Perhaps it is because Hillary won the popular vote in the primary and may very well have won the nomination if not for the “super delegates” in the Democrat nomination process that can overturn the will of the people. The media also was piling on Hillary to “quit the race it was hopeless” when it fact it was not hopeless at all until the “super delegates” shut it all down.

Ironic that the party who always talks about Democracy and even bends/breaks the rule of law when its convenient to achieve it when it suits them has the process that is the least democratic.

Welfare Reform was a smashing success at lowering poverty. Now it’s undone. Funny how Obama didn’t mention this in his trip to Elkhart. Do you understand why he had to do this “NOW”? He had to get it done before people like you and I found out about this.
