UK Times: UN Workers Steal Food from the Starving

Posted by iusbvision on June 15, 2009

UK Times:

One of the UN’s largest international relief efforts is under investigation after it emerged that thousands of sacks of food aid were being diverted from starving refugees and openly sold for profit.

The head of the UN’s $955 million (£580 million) aid operation in Somalia has launched an inquiry after being shown footage showing tonnes of food bearing the World Food Programme (WFP) logo widely on qA–sale in Mogadishu, the capital.

Stacks of bags of maize and wheat and tins of cooking oil — marked “not for re-sale” and bearing the UN stamp — are on sale from ten warehouses and 15 shops in the city’s main market.

About 45,000 tonnes of WFP food are shipped to Somalia from Kenya every month. Mogadishu traders told Channel 4 News that they bought their supplies straight from UN staff. “We buy [food] aid from WFP staff directly or from people they employ,” one market trader said.

“They take us to the warehouses used by the WFP and let us load our lorries. The goods are freely available and you can buy as much as you like, but we usually buy no more than 500 to 1,000 sacks at a time. Just a tonne or half a tonne a day can be shifted more discreetly.”

Obama administration calls Indiana Pension Fund attorney a “terrorist” for protecting their car company bonds.

Posted by iusbvision on June 15, 2009

The Obama Administration wants to ignore the law and cheat secured bond holders in nationalized car companies by not allowing them to get paid back withion the terms of the law so he can illegally funnel more money to unsecured union stock holders. One of those secured bond holders who the administration tried to cheat is the Indiana Pension Fund. The State of Indiana sued to uphold the law. comments:

When we last left the negotiations between Chrysler’s senior bondholders and Barack Obama’s auto task force, Thomas Lauria and his clients alleged that the government used intimidation tactics and threatened to sic the White House press corps on individuals if they didn’t give up their rights to allow the unions to win in the bankruptcy. Congress took an interest in this”madman” theory of the Presidency and got access to some e-mails floating between the task force and an analyst.  Rep, Steven LaTourette (R-OH) reads from the e-mails, in which the auto task force calls Lauria — their attorney — a “terrorist” and refuses to negotiate after a Chrylser expert consulted him:

Ms Underestimated writes:

The important part comes at the end: an email exchange between Matthew Feldman, attorney on the President’s Auto Task Force, and Robert Manzo, Chrysler restructuring expert. Manzo is basically pleading to further negotiate to prevent bankruptcy, but Feldman is having none of it. Here is the exchange:

Robert Manzo, Chrysler restructuring expert: “I hope you think it’s worth giving this one more shot.”

Matthew Feldman, attorney on the President’s Auto Task Force: “I’m now not talking to you. You went where you shouldn’t.”

Manzo: “Sorry. I didnt’ mean to say the wrong thing and I obviously did. I was trying oto make sure that if we had to contribute to the solution you knew we had some room. Sorry I did not realize the mistake!!”

Feldman: “It’s over. The President doesn’t negotiate second rounds. We’ve given and lent billions of dollars so your team could manage this properly….And now you’re telling me to bend over to a terrorist like Lauria? That’s B.S.”

A terrorist like Lauria? Lauria represented a teacher’s pension fund in Indiana (among other bondholders), and had the temerity to insist that the government follow contract law.  I may be no fan of lawyers, but I don’t call them terrorists.  Apparently the White House has another view of lawyers, especially when they insist that the government follow the law.

In this process, we see which side tried to terrorize the other, and it wasn’t Lauria’s.

Hotair and Missunderestimated could not have explained this better.

Car dealerships being closed that are profitable are owned by mostly GOP donors.

Posted by iusbvision on June 15, 2009

A large portion of the list of GOP donors being targeted is HERE.

The B-Cast did its afternoon show on this subject HERE (video).

Democrat Barney Frank the Chair of the House Bank & Finance Committee used his influence to stop a dealership from being closed in his district.

Of those dealerships being close 90% gave to Republicans, 10% gave to Democrats.

Former Clinton Chief of Staff Mac Maclarty who owns a large chaion of dealerships had none ordered closed. Eight of McClarty’s competitors were shut down.

Many of those dealerships were given days to sell their intire inventory ot have no warranty on any cars they have left. GM/Chrysler are also trying to impose a gag order on these dealerships to intimidate them into not talking with the media. – Video:

GOP members of Congress who have family that own dealerships are getting notices that they will be shut down in spite of being profitable link HERE.

This video is from when the story was young and at the beginning of the investigation:

Gretchen Carlson on profitable car dealerships being shut down.

Democrats propose “health care” law with $600 Billion in new taxes. Move to tax your health care benefits.

Posted by iusbvision on June 14, 2009

Barack Obama threatened voters in the campaign that if John McCain was elected president that you would face taxes on health care benefits. McCain proposed no such thing, but just a few months after Obama’s inauguration for the second time Democrats are proposing doing just that. Critics say the plan to tax your health care benefits is designed to price private health insurance out of the market allowing a government plan to take over.

Barack Obama also promised in the campaign that if you made under $250,000 a year you would face not one dime in new taxes. This promise was broken almost immediately with new taxes on tobacco and the unfunded mandates that came as strings attached to the stimulus bill funds which has forced many states such as Indiana to raise taxes in order to pay for them. If the new health care bill proposed by Democrats become law that promise will have been broken for the third time.

Bloomberg News:

June 12 (Bloomberg) — Health-care overhaul legislation being drafted by House Democrats will include $600 billion in tax increases and $400 billion in cuts to Medicare and Medicaid, Ways and Means Committee Chairman Charles Rangel said.

Democrats will work on the bill’s details next week as they struggle through “what kind of heartburn” it will cause to agree on how to pay for revamping the health-care system, Rangel, a New York Democrat, said today. The measure’s cost is reaching well beyond the $634 billion President Barack Obama proposed in his budget request to Congress as a 10-year down payment for the policy changes.

Asked whether the cost of a health-care overhaul would be more than $1 trillion over a decade, Rangel said, “the answer is yes.” Some Senate Republicans, including Senator Orrin Hatch of Utah, say the costs will likely exceed $1.5 trillion.

House Democrats plan to release their legislation next week. Obama is working with Congress to get legislation to his desk by October.

What ATI Catalyst Driver is best for your card?

Posted by iusbvision on June 12, 2009

This is a question that computer guru’s are asked frequently, “I have an ATI video card and what ATI driver version is the best for me?” or “What catalyst driver is best for World of Warcraft?”

Some people reflexively say “the latest one” but tests show that this is not always the case. Unless you need a specific driver version that fixed a specific bug for your favorite game, for ATI card owners the correct driver for you is the driver that contains what is known as “the sweet spot”; that is, the driver version that was optimized for your series of ATI card.

You see each driver version is designed to take advantage of ATI’s latest piece of hardware on the market. When Catalyst 8.2 came out the ATI 3870 was the top of the line card, my ATI 3850 is nearly the same piece of hardware so it is no surprise that with the 8.2 driver in Half-life: the Lost Coast this driver nets me 116 FPS in the video stress test, but the newer 8.12 driver only nets me 105 FPS, the newest 9.x series driver net me under 90 FPS.  When the 8.4 driver came out the ATI 4700 series cards came out so the drivers were optimized for that piece of hardware instead of my 3850.

The Tweaktown website gives a catalyst performance review of each driver set and you can look at the benchmarks of the older drivers and see which driver version gives your ATI card had the highest frame rate. For 3800 series card owners the 8.2 is solidly the best performing driver and only reason to use another version would be if you had a game specific bug with that driver that you needed to work around.

For the record, between driver version tests I ran the ATI uninstall utility, driver cleaner pro and CCleaner between installing each driver version for testing. In World Of Warcraft in Silvermoon City at the mailbox by the main gate looking into town I got 37 FPS with the 9.5 driver, the same with the 9.4. I recived 54 FPS with the 8.12 driver and 104 FPS with the 8.2. The card in my machine is a 3850 from Sapphire.

Letterman Lied: He Knew His Rape Joke About Willow Palin Was About a 14 Year Old – UPDATE: Letterman Apologizes

Posted by iusbvision on June 11, 2009

As you have all seen the latest excuse from David latterman is that he thought the daughter that was with Sarah Palin was the 18 year old Bristol and not the 14 year old Willow (in the end it doesnt matter that much, rape jokes are just not funny).

Our friends at Hillbuzz have the evidence and it is pretty compelling:

There is just no way possible for David Letterman to claim, as he did on television last night, that he didn’t know he was brutalizing 14-year-old Willow Palin on Tuesday (but instead wanted to attack her older sister).

When Sarah Palin took this recent trip to New York to celebrate Secretary Seward’s purchase of Alaska, the abolitionist and women’s movements, and to show her daughter a good time in New York, we were surprised it was Willow in tow this time, and not the more usual Piper as her mother’s traveling companion.

Since last week, there’s been non-stop reporting of Willow Palin in upstate New York with her mom and dad. Willow Palin in a parade in Auburn, New York. Willow Palin at Harriet Tubman’s house. Willow Palin with her mother at a Yankees game in the new stadium.

14-year-old WILLOW PALIN.

For someone as obsessed with the Palins as Letterman clearly is, it’s absolutley impossible for him not to know the Palin daughter he said was statutorily raped by Alex Rodriguez (in his joke that “Palin’s daughter got knocked up” at the Yankees game) was 14-year-old Willow.

SOMEONE on his staff did enough research to know the Palins went to the Yankees game — try this experiment for yourself and try Googling anything on Sarah Palin + daughter + Yankees Game, and Willow’s name will pop right up not four words from her mother’s name over and over and over again.

Letterman knew exactly what he was doing. He wanted to hurt Palin where it matters most: her family. He most likely always had his non-apology prepared ahead of time as well — as we speculated yesterday when we said, “Watch, he’ll probably claim he was talking about Bristol and will think that makes all of this okay. But, he knew it was Willow. Everyone knew Willow was the daughter traveling this time. But Letterman will lie and try to weasel out of this and claim he was attacking the oldest daughter instead.”

Slimeballs have excuses like this on file before they do things they know are wrong. You’ve certainly had people like this in your lives, we bet. Husbands who cheat, buying cans of paint or something ahead of time and keeping them in the trunk so when they “go out to Home Depot for a while to get paint”, they can really pop over to a motel for a fling. But they think they’re smart because they have that paint to walk in with as their alibi.

Only, the receipt in the bag is from yesterday, not tonight.

UPDATE: David Letterman has now officially and fully apologized for his nasty sex jokes about Gov. Palin’s daughter. The apology seems sincere but in all fairness it must also be said that this has been a rating bonanza for Letterman, he himself has helped to keep this in the news by bringing it up repeatedly on his show and he did try to use this to get Gov. Palin on the show. Publicity is publicity is ratings during sweeps week. If this was not sweep time I would be less skeptical of this apology. Lets just face the facts some people have done worse things during sweeps week to get attention (sweeps is the weeks where the ratings are officially taken to set the advertising prices till the following season).

“All right, here – I’ve been thinking about this situation with Governor Palin and her family now for about a week – it was a week ago tonight, and maybe you know about it, maybe you don’t know about it.  But there was a joke that I told, and I thought I was telling it about the older daughter being at Yankee Stadium. And it was kind of a coarse joke. There’s no getting around it, but I never thought it was anybody other than the older daughter, and before the show, I checked to make sure in fact that she is of legal age, 18. Yeah. But the joke really, in and of itself, can’t be defended. The next day, people are outraged. They’re angry at me because they said, ‘How could you make a lousy joke like that about the 14-year-old girl who was at the ball game?’  And I had, honestly, no idea that the 14-year-old girl, I had no idea that anybody was at the ball game except the governor and I was told at the time she was there with Rudy Giuliani … and I really should have made the joke about Rudy …” (audience applauds) “But I didn’t, and now people are getting angry and they’re saying, ‘Well, how can you say something like that about a 14-year-old girl, and does that make you feel good to make those horrible jokes about a kid who’s completely innocent, minding her own business,’ and, turns out, she was at the ball game. I had no idea she was there. So she’s now at the ball game, and people think that I made the joke about her. And, but still, I’m wondering, ‘Well, what can I do to help people understand that I would never make a joke like this?’ I’ve never made jokes like this as long as we’ve been on the air, 30 long years, and you can’t really be doing jokes like that. And I understand, of course, why people are upset. I would be upset myself.
“And then I was watching the Jim Lehrer ‘Newshour’ – this commentator, the columnist Mark Shields, was talking about how I had made this indefensible joke about the 14-year-old girl, and I thought, ‘Oh, boy, now I’m beginning to understand what the problem is here. It’s the perception rather than the intent.’ It doesn’t make any difference what my intent was, it’s the perception. And, as they say about jokes, if you have to explain the joke, it’s not a very good joke.  And I’m certainly – ” (audience applause) “– thank you. Well, my responsibility – I take full blame for that. I told a bad joke. I told a joke that was beyond flawed, and my intent is completely meaningless compared to the perception. And since it was a joke I told, I feel that I need to do the right thing here and apologize for having told that joke. It’s not your fault that it was misunderstood, it’s my fault. That it was misunderstood.” (audience applauds) “Thank you. So I would like to apologize, especially to the two daughters involved, Bristol and Willow, and also to the governor and her family and everybody else who was outraged by the joke. I’m sorry about it and I’ll try to do better in the future. Thank you very much.” (audience applause).

More jobs have been lost with the “stimulus bill” than Obama said we would lose if it wasn’t passed.

Posted by iusbvision on June 10, 2009

Its true. Now the administration is coming out with new rosey job forcasts because the old ones proved to be a joke, read about it HERE in the Wall Street Journal. Here is an exerpt:

“You created a situation where you cannot be wrong,” said the Montana Democrat. “If the economy loses two million jobs over the next few years, you can say yes, but it would’ve lost 5.5 million jobs. If we create a million jobs, you can say, well, it would have lost 2.5 million jobs. You’ve given yourself complete leverage where you cannot be wrong, because you can take any scenario and make yourself look correct.”

Now, something’s wrong when the president invokes a formula that makes it impossible for him to be wrong and it goes largely unchallenged. It’s true that almost any government spending will create some jobs and save others. But as Milton Friedman once pointed out, that doesn’t tell you much: The government, after all, can create jobs by hiring people to dig holes and fill them in.

If the “saved or created” formula looks brilliant, it’s only because Mr. Obama and his team are not being called on their claims. And don’t expect much to change. So long as the news continues to repeat the administration’s line that the stimulus has already “saved or created” 150,000 jobs over a time period when the U.S. economy suffered an overall job loss 10 times that number, the White House would be insane to give up a formula that allows them to spin job losses into jobs saved.

“You would think that any self-respecting White House press corps would show some of the same skepticism toward President Obama’s jobs claims that they did toward President Bush’s tax cuts,” says Mr. Fratto. “But I’m still waiting.”

Letterman calls Gov. Palin’s daughter a prosititute. Makes rape joke about Palin’s 14 year old. – UPDATED!

Elliot Spitzer was caught with a young prostitute in case you didn’t get the “joke”.

He also attacked Gov. Palin’s 14 year old daughter Willow with this:

UPDATE II: Bill O’reilly is reporting that most of the major newspapers have ignored this story. Imagine if a Republican had said this about Chelsea Clinton or one of Obama’s daughters, would the story be ignored? Oh thats rights it’s the media and the far left sexist double standard, Sarah Palin is a woman in elected office so its ok to makes these types of attacks against her OK.

UPDATE – The PUMA PAC blog has a great post on this situation.

Editor’s Note: Before I get to their post, for those that don’t know, PUMA is a wing of the Democratic Party that supported Hillary Clinton in the last election, they were not pleased by the Obama Campaign’s sexist attacks against Hillary Clinton (some of which we catalogued ion this web site as well) they were also not pleased thatthe so called “super delagates” in the Democratic leadership called the primary for Barack Obama when Hillary was surging ahead and actually enjoyed a popular vote lead in the primary. It was dirty. PUMA stands for “Party Unity My A$$”. The Chicago style election diry tricks used against Hillary are no secret to those who follow politics closely. To the PUMA’s credit, they displayed real intellectual honesty when they saw the same dirty tricks and sexist double standards used against Sarah Palin. Some PUMA blogs and groups were so disgusted that they could not support the Obama ticket and from a policy perspective this made sense as well, because policy wise McCain and Hillary are closer together than the very far left policy decisions that we have seen from the Obama Administration.

PUMA’s have also seen how Obama has carved up the juristictions in the State Departent leaving Hillary almost powerless as Secretery of State.

Here’s John Ziegler putting the conventional feminist movement to shame:

Contessa, Contessa, Contessa. Sexism doesn’t KILL you, you lying hypocrite. At least not very often. What it does is limit your opportunities and jeopardize your ambitions. If I had been in Ziegler’s chair I think I would have responded to her ridiculous statement that she had been called slutty and survived it okay with, “Well, Contessa, perhaps being seen as a slut is a benefit in your industry.” I wonder if she would have gotten the point. Probably not.

Dear CBS,

David Letterman should be publicly censured for his offensive and sexist attempts to ridicule Sarah Palin and her daughters on June 9th. Last night’s non-apology is FAR from sufficient to address the damage he has done. Calling public figures “slutty” and implying that a young girl being raped and/or becoming pregnant as a result of unwanted sex with a much older man for LAUGHS is absolutely out of bounds, and is not funny in any context.

Dear Republicans, quit being stupid…..

Posted by iusbvision on June 8, 2009

Wishy washy little games like this is exactly what the GOP base, Independents and Reagan Democrats are sick of.

Sarah Palin’s on-again, off-again appearance at Monday night’s gala GOP fundraising dinner is off — again.

After being invited — for a second time — to speak to the annual joint fundraiser for the National Republican Congressional Committee and the National Republican Senatorial Committee, Palin was told abruptly Saturday night that she would not be allowed to address the thousands of Republicans there after all.

The Alaska governor may now skip the dinner altogether, and her allies are miffed at what they see as a slight from the congressional wing of the Republican Party.

The reason given for the snub, said a Palin aide, was that NRCC Chairman Pete Sessions was concerned about not wanting to upstage former House Speaker Newt Gingrich, the fundraising gala’s keynote speaker.

“A great deal of effort has been put into this fundraising event, and Speaker Gingrich has gone above and beyond the call of duty,” said NRCC spokesman Ken Spain. “It is our hope that Gov. Palin will attend the dinner and be recognized, but we understand if her busy schedule doesn’t permit her to do so.”

The disinvitation from speaking, said a campaign committee official, was done “out of respect” for Gingrich.

It is not about ego’s and fiefdoms, its about Ideas and the sooner the NRCC learns that lesson the better off it will be. And while Newt is a great “ideas man” it takes money to get those ideas out there and to get a message delivered. Palin is a fund raising machine like the GOP hasn’t seen in ages. Too many in the GOP have still not learned their lesson from the last two elections. The Democrats like Top Down action for most everything, for the GOP it has always been about bottom up and Palin connects with the common man better than anyone.

Palin loves to tear down corrupt lil schemes, especially ones in her own party. Too many Republicans in Congress are still in the mindset that they want the GOP to be the party of corrupt, neo-corporatist, big government B. If Palin ever takes power in Washington that entire structure will be in great jeopardy and that is exactly why so many were happy to have voted for her.

Left-Wing Parties Losing Across Europe

Posted by iusbvision on June 8, 2009

Left wing parties are losing big all over Europe. The British sosiclists lead by Prime Minister Gordon Brown are in for a pasting in the near future. Brown’s Policies are very similar to the Obama Administration and have had more time to “work”. The result has been a very predictable disaster. The voters have had enough.

Der Spiegel:

The center-right European People’s Party (EPP) held on to its position as the largest grouping in the European Parliament, with provisional results giving them 267, or around 36 percent, of the assembly’s 736 seats. The center-right’s showing was even better than indicated by the EPP’s results, as many euroskeptic members of the European Parliament are moving to other parliamentary groups.

The vote’s biggest loser is the center-left, with the Party of European Socialists (PES) winning just 159 seats, 56 fewer than in the 2004 election. “Tonight is a very difficult evening for Socialists in many nations in Europe,” Martin Schulz, lead candidate for Germany’s Social Democrats and the floor leader for the PES in the European Parliament, said on Sunday evening.

AP: Big government spending programs are turning out to have the opposite effect

Posted by iusbvision on June 7, 2009

Today the AP is saying exactly what we and others who understand economics and economic history have told you since before the election. Big bailouts and government spending and regulation fervor doesn’t work, it slows economic growth and it undermines investor confidence. Unfortunately only about 20% of economists truly understand economics as it takes the ability to spot and recognize patterns in what appears to be chaos.

This kind of stuff did not work during the great depression and it’s not working now [1, 2, 3, 4].The economy went soaring after the soldiers came home and government spending dropped by 2/3’s. While there was a great deal of spending during WWII, the non-military producing private sector continued to shrink until 1946.

Associated Press:

The Federal Reserve announced a $1.2 trillion plan three months ago designed to push down mortgage rates and breathe life into the housing market.

But this and other big government spending programs are turning out to have the opposite effect. Rates for mortgages and U.S. Treasury debt are now marching higher as nervous bond investors fret about a resurgence of inflation.

That’s the Catch-22 threatening to make an awful housing market potentially worse and keep the economy stuck in a funk. Kick-starting the economy requires higher spending, but rising rates mean fewer Americans will be able to refinance their home loans. And some potential buyers will be shut out of the market by higher monthly payments they won’t be able to afford.

To understand how this is all connected, you have to think like a bond trader. Inflation is their enemy because it means the purchasing power of the dollars they receive when bonds eventually are paid off will be diminished. The only question is by how much.

NBC Brian Williams Bows to Obama – Daily Mocks NBC Fawning Coverage

Krauthammer Explains How Obama’s Cairo Speech Emboldens U.S. Enemies

Posted by iusbvision on June 5, 2009

As usual, the incredible mind of Charles Krauthammer cuts to the quick of the issue. Korea and Iran can smell weakness like a fart in a car which explains their stepped up recent behavior. As usual, those in the elite media fawned all over the speech without giving serious substantive analysis.

Speaking of moral equivalencies:

It’s always the same with these bogus equivalences: They start by pretending loftily to find no difference between aggressor and victim, and they end up by saying that it’s the victim of violence who is “really” inciting it.  – Christopher Hitchens

Playboy Column Advocates “Hate Rape” Against Conservative Women

Posted by iusbvision on June 5, 2009

This is the latest “shut up” argument from the left. The far left wishes to dehumanize their political enemies so that eventually it will become socially acceptable to do violence against them.

UPDATE: reports that political writer Tommy Christopher was FIRED for criticising Playboy for the column.

If Rush Limbaugh had advocated “Hate Rape” against Katie Couric or Nancy Pelosi you would ever hear the end of it on TV but as usual those who behave as if they are the state run media are mum… and yet it is Rush who they claim is hateful ….

Special thanks to the great Johnny Dollar web site.

Community college willingly violates law and risks lawsuit in foolish attempt to censor constitutionally protected speech.

A community college in Pennsylvania is facing a lawsuit that they have no possibility of winning in a hapless attempt to censor student speech. Examine this press release from FIRE.

Pittsburgh-Area College Fails to Remedy Violations of Concealed Carry Advocate’s Free Speech

June 2, 2009

FIRE Press Release

PITTSBURGH, June 2, 2009A student who wants to form a gun-rights group will still be subject to unconstitutional censorship, the Community College of Allegheny County (CCAC) announced yesterday. Christine Brashier, who wants to form a chapter of Students for Concealed Carry on Campus (SCCC), was told through a letter to the Foundation for Individual Rights in Education (FIRE) yesterday that she will not be punished for her efforts to organize the group, as college officials had threatened in an earlier meeting, but only if she follows CCAC’s unconstitutional policies. She must have all of her pamphlets approved before distribution and will not be allowed to use the name of CCAC in any way during her effort to start a group at the college.

“CCAC’s response was a transparent attempt to defend the indefensible,” said FIRE President Greg Lukianoff. “The college’s justifications for its censorship of Christine Brashier are not only unconstitutional, they are absurd.”

In April, Brashier created pamphlets to distribute to her classmates encouraging them to join her in forming a chapter of the SCCC national organization at CCAC. Her pamphlets stated that the group “supports the legalization of concealed carry by licensed individuals on college campuses.” She personally distributed copies of the pamphlets, which identified her as a “Campus Leader” of the effort to start the chapter.

Brashier was quickly summoned to a meeting with administrators, who told her that passing out her non-commercial pamphlets was prohibited as “solicitation.” Furthermore, they insisted that the college pre-approve any pamphlets, that pamphlets like hers would not be approved, and that Brashier destroy all copies of her pamphlet. At one point during the meeting, Dean Yvonne Burns reportedly said, “You may want to discuss this topic but the college does not, and you cannot make us.” Brashier was warned that any further efforts would be considered “academic misconduct.”

FIRE wrote CCAC President Alex Johnson on April 29 about these violations of Brashier’s First Amendment speech and association rights, pointing out that her free speech in no way constituted solicitation, that CCAC may not condition approval of literature on its viewpoint or content, and that if CCAC recognizes student organizations at all, it must recognize an organization that supports concealed carry on campus.

FIRE took Brashier’s case public last week, generating widespread news coverage. As a result, Allegheny County Solicitor Mike Adams finally replied to FIRE Monday on CCAC’s behalf. Rather than affirming Brashier’s expressive rights, however, Adams tried to justify CCAC’s unconstitutional actions after the fact. While Adams assured FIRE that Brashier did not face any disciplinary action and that she did have the right to try to form a SCCC groupreversing the message Brashier received from Dean Burnshe ignored most of the alarming statements by the CCAC administrators and attempted to defend CCAC’s unconstitutional censorship.

Most outrageously, Adams sought to defend CCAC’s policy of demanding prior review and prior restraint of handbills and pamphlets. Adams attempted to justify this unconstitutional policy by arguing that Brashier’s use of the CCAC name and her self-identification as the “Campus Leader” of the effort to organize the gun-rights group might lead a reasonable person to erroneously assume that the group and its message were endorsed by CCAC.

“The Supreme Court has determined that prior restraint is rarely justified, even for national security reasons,” said FIRE Vice President Robert Shibley. “For Allegheny County to argue in favor of a government veto over privately-produced handbills makes a mockery of the First Amendment. Under this reasoning, Thomas Paine should have sought the British government’s permission to distribute his pamphlet Common Sense.”

[FIRE is right on the legal grounds. A famous legal test case of the law is New York Times v. United States. The NYT moved to publish leaked classified documents and the Supreme Court ruled that the government could not use “prior restraint” to keep the NYT from publishing them. This case is famous and is studied in almost every university in the country. How can CCAC hope to have a chance to get away with this? How could they be so outrageously foolish? – Editor]

Also troubling is CCAC’s argument that simply using the name of CCAC in a handbill promoting the formation of a group on that campus implied CCAC’s endorsement of the group and its message. “CCAC has officially recognized chapters of the College Democrats and the Newman Club. Does that mean CCAC officially endorses Democratic politics and Catholicism? Obviously not. Such a conclusion is patently unreasonableas is CCAC’s weak attempt to spin away the violation of a student’s First Amendment rights,” Shibley said.

“CCAC students, as well as every citizen of Allegheny County, should feel very disappointed by the county’s apparent disregard of fundamental rights. FIRE will continue to pursue this matter until the First Amendment is restored to CCAC’s campus,” Lukianoff said.
