Politico.com interviews new media news mogul Andrew Brietbart at CPAC. A bit harsh in his rhetoric, but what Breitbart says has a great deal of truth and cannot be ignored.

Andrew Breitbart slammed failed MSNBC host Rachel Maddow at CPAC yesterday.

Breitbart accused Maddow of being “part of a propaganda campaign to attack the last president … and make him out to be the worst human being that ever walked the face of the earth. And, at the same time, you promoted Barack Obama as the greatest thing that ever walked the earth.”

“The tea party movement and the rebellion that you’ve seen in Massachusetts and across the country, is not because Barack Obama stinks as bad as he does. It’s because you oversold him and you undersold the last president. In the era of new media there’s checks and balances for the type of propaganda you serve up and if you think you can unring this bell… you’re wrong.”

Bill O’Reilly Supports Gun Confiscation During Weather Emergencies – UPDATED!

O’Reilly blew it here. The National Rifle Association (NRA) sued New Orleans and won over those gun confiscations. New Orleans broke the law and ended up paying the price for it. President Bush also signed an executive order forbidding the confiscation of firearms in a declared emergency.

The Second Amendment exists for events just like Katrina when civil enforcement breaks down and the law of the jungle takes over in the chaos.

What is even more interesting is that I specifically remember Bill O’Reilly stating that Katrina changed his views on gun control because of Katrina he learned that the government can’t protect you and you have to protect yourself. It seems O’Reilly changed his views to skewer this man from the Oathkeepers.

I called the NRA public relations office today and informed them of this. They were unaware of this because they were all at CPAC. They assured me that they will take action.

O’Reilly also took the position that it should never be the position of the soldier to determine what orders are legal and what orders are not. The man from Oathkeepers was correct in pointing out the Nuremberg trials where soldiers were prosecuted for following orders.

I am surprised that O’Reilly went into this interview so unprepared. I don’t know anything about this Oathkeepers group and if they are extreme or not, but on these two particular points of law the man with Oathkeepers is quite correct. The man from Oathkeepers should have been more assertive in the face of O’Reilly’s ignorance in this matter.

I sent the following letter to Bill O’Reilly:

Dear Bill,

When I was in basic training the military training instructors beat it into our heads that it was our duty to disobey an unlawful order. We were told with no ambiguity whatsoever that it was the individual soldiers responsibility to know the Constitution and the UCMJ (law and military law). We were also told that orders should never be an excuse for mission failure. In several wars plans and orders were rendered ineffective upon contact with the enemy, and that in the battlefield we may have to violate orders and improvise or come up with new plans on our own to complete the mission if circumstances demanded.

UPDATE – Wow the ignorance continues. There is no excuse for O’Reilly’s staff to have missed that a court of law ruled that the New Orleans state of emergency doe not allow the government to confiscate guns. A simple call to the NRA would have given them all the info they need, as would a lexis/nexis search. There is no excuse for O’Reilly and his staff to miss this. Tonight O’Reilly doubled down on this ignorance.

O’Reilly uses the example of Abe Lincoln revoking Habeas Corpus during the Civil War. The Constitution gives Congress the power to revoke Habeas Corpus not the President. Lincoln acted illegally and there is no excuse for blowing it on this simple point of history as well. O’Reilly’s argument is now basically thus, “you must obey an unlawful order until a court of law says that order is wrong”. That argument absolves the soldier and the police officer and the public servant from responsibility to their oath…until a court says so. That defense didn’t work in Nuremberg and it doesn’t work here.

I do not believe that a few years ago mistakes compounding mistakes that a few minutes of records and history searches would resolve would happen on the O’Reilly Factor. Someone is getting lazy and needs a kick in their complacency. This is journalistic incompetence in action.

Flashback  – Andrew Breitbart exposes how CNN deliberately misreported the story.

Breitbart was sick of the CNN hit pieces in Giles-O’Keefe who should get a Pulitzer for their work exposing the ACORN story. So he offered to let Giles and O’Keefe come on CNN even for a hit piece, provided that CNN showed the video’s to let the viewers decide for themselves. CNN refused.

Only 21% Say U.S. Government Has Consent of the Governed

I have never witnessed polls like this, Americans are showing a clear contempt for both political parties and after seeing this it becomes clear why Tea Party is polling ahead of both Democrats and Republicans. Also note the massive disconnect between the political class the the governed.

Speaking as a political scientist, these numbers show that the government is losing its legitimacy (please be sure you know hat that word means in poli-sci terms before you comment). This can only mean big changes are ahead.

There is also an indicator that independents may be more conservative than Republicans now, if this trend continues it changes everything.

Rasmussen Reports:

The founding document of the United States, the Declaration of Independence, states that governments derive “their just powers from the consent of the governed.” Today, however, just 21% of voters nationwide believe that the federal government enjoys the consent of the governed.

A new Rasmussen Reports national telephone survey finds that 61% disagree and say the government does not have the necessary consent. Eighteen percent (18%) of voters are not sure.

However, 63% of the Political Class think the government has the consent of the governed, but only six percent (6%) of those with Mainstream views agree.

Seventy-one percent (71%) of all voters now view the federal government as a special interest group, and 70% believe that the government and big business typically work together in ways that hurt consumers and investors.

That helps explain why 75% of voters are angry at the policies of the federal government, and 63% say it would be better for the country if most members of Congress are defeated this November. Just 27% believe their own representative in Congress is the best person for the job.

UPDATE – In this video Obama says that his only affiliation with ACORN was to help represent them in a “motor voter” lawsuit. Hmm what about the bank lawsuits hmmm? And what about the previous bragging you did on video talking about your long history with ACORN and all the political races you worked with them on? What about when you used to train their community organizers? What about the fact that ACORN/SEIU share facilities and the SEIU President has visited the White House on numerous occasions?  Well the video speaks for itself.

Senator Obama said: “Senator McCain offered up the oldest Washington stunt in the book: you pass the buck to a commission to study the problem. But here’s the thing: this isn’t 9-11. We know how we got into this mess. What we need now is leadership that gets us out.”

Apparently, then, we can dismiss Senator Obama’s call for commissions on Social Security (11/2007), torture (9/2007), war crimes (8/2008), and financial oversight for Wall Street (4/2008) as four separate instances of the senator pulling “the oldest Washington stunt in the book.” Perhaps the person who ghost writes his teleprompter can first do a Google search on the senator’s behalf to see whether he had opined on prior occasions on the matter of commissions. It took me about 40 minutes to track all these down.

As I have said repeatedly in political science classes for years, when politicians make “task forces” they are designed to do one thing, shirk responsibility and justify plans that the voters would not likely accept.

I remember the “Base Closure Commission” after the so-called “peace dividend” after the Wall fell in Germany. The commission would decide what military bases were closed based on “merit” and “the mission”. The truth is that the majority in Congress manipulated the commission and bases were kept open that should not have, and bases were closed that should not have, but the politicians could say “Hey don’t blame me, it was that darn commission (shhhhh… which we made for the express purpose of shirking responsibility to)”.

Both Bill Clinton and George Bush are on the record stating that the 9/11 Commission was a “political document” and they were right. Jamie Gorelic who sat on the commission should have spent the bulk of her time testifying in front of it for the now infamous “Gorelic Wall” that made connecting the dots on the 911 intelligence all but impossible… I could right 10 more pages on what a mess the 9/11 commission was.

The rhetoric and reasoning behind making these “commissions” makes it all sound so good on paper, but usually end up with flawed results that are easily influenced by the media and politics. The “independent prosecutor” statute suffered from the same ills. Lawrence Walsh, Patrick Fitzgerald and most of the others all went on self-serving high-profile political persecutions. Ken Starr may have been the best of the whole lot and can anyone claim that he wasn’t influenced by politics?

So why is Obama’s new Deficit Commission a scam?

The state of the debt is so bad that everyone is going to have to pay at least some tax, rather than the top 50% paying 96% of all taxes (the Fair Tax is the smartest way to get this done and still grow the economy). The economy is going to have to be grown as well so there is more economy to tax which means incentivizing economic interests to invest and produce here in the United States. That is hard to do when you have an anti-business philosophy and a tax tax tax redistribute the wealth ideal for utopia.

Obama, like all politicians, will want to pick and choose what recommendations the commission will propose and then they will implemented by the Democrat leadership ins such a way as to meet their political needs and  not necessarily do what is economically the most prudent. In short, no matter what the commission says, Obama will say that the commission wants him to raise taxes, regulate more, and do what he wants to do anyways. He will say “I was reserved about the whole thing but the American people wanted an unbiased opinion and I am implementing it” as which time he will use this as an excuse to break his $250,000 tax pledge and engage in more of the same like his failed stimulus package which is proving to look more and more like a political slush fund.

I wanted to see if anyone else had the same take as I did and I was glad to find this video on YouTube. The Washington Post’s Charles Krauthammer and Rush Limbaugh explained it with their usual skill:

Obama and the Democrats have raised government spending almost 20% to a point where the CBO has said is unsustainable. Obama is hoping to lock in the new higher levels of spending and “compromise” some of it away, call them “cuts” and tell the American people how “fiscally conservative” he is.

International Luge Federation Blames Death of Georgian Athlete on “Human Error” – Later Admits Track Did Not Meet Design Specs

Shirking responsibility even in the face of the death of an athlete irritates me, especially when a lie becomes obvious.

Luge Olympian 21-year-old Nodar Kumaritashvili of the Republic of Georgia was killed after a turn it what is designed to be the fastest luge track in the world.

The International Luge Federation blamed the death on athlete error:

The International Luge Federation (ILF) has blamed the crash on the luger and not on any “deficiencies in the track,” saying that Mr. Kumaritashvili “did not compensate properly to make the correct entrance” into the curve where he slid off the track at the Whistler Sliding Centre.

Later the ILF changed it’s story, not about athlete error, but the track itself:

Despite those assertions, Olympic officials took unusual measures on Saturday to shorten the course by 190 yards to slow the speeds, and they altered the run to keep lugers on the track should they crash [they raised the height of the wall after that turn – Editor].

Josef Fendt, president of the luge federation, said on Saturday that the track is safe, but that it had turned out to be far faster than designers ever intended it to be. He said that when designers drew up plans for the winding icy slope on the side of Blackcomb Mountain, 76 miles north of Vancouver, they anticipated speeds of about 87.5 miles per hour. During test events at the facility last year and in training runs before these Olympics, the lugers had been traveling at speeds of 96 miles per hour.

“We did not expect these speeds on this track, but after a while we determined that the track was safe,” Mr. Fendt said. He reiterated comments from last year that luge organizers need to consider a speed limit in the design of future tracks.

I saw an interview with a luge specialist on Russia Today and he said that the tracks are designed to keep the body on the track and not come out in case of an accident.

The video below shows the accident and death of the athlete, normally we would not choose to show this but the video is critical to the story analysis. One can clearly see that right after that sharp turn the walls become very low and there is a line of steel girders right after the wall falls low just after the turn. After watching the video it is obvious why they changed the track as they did.  

Other athletes almost suffered the same price on that track. The UK Independent reports:

Georgian President Mikheil Saakashvili wasn’t buying the “athlete error” dodge either:

This is nothing short of a scandal.

New N.J. Gov. Christie Freezes Spending – Keeps Campaign Promise – Democrats Furious – UPDATED!

Calling New Jersey’s budget a “shambles,” Gov. Chris Christie announced Thursday he is immediately freezing all state spending.

Saying New Jersey is on the verge of bankruptcy, Christie declared a fiscal emergency, announcing drastic cuts. Among them, aid to school districts that have excess surpluses.

“Today we are going to act swiftly to fix problems too long ignored. Today I begin to do what I promised the people of New Jersey I would do,” Christie said.

The move had Democrats in an uproar, angry the governor used his executive powers instead of working with the Legislature.

“What that’s going to mean is that those school districts without that money are going to be raising property taxes in the upcoming year to make up for that shortfall,” said Assemblyman John Wisniewski, D-19th District.

The governor also cut state subsidies to New Jersey Transit, saying it needs to become fiscally efficient.

“Revisit its rich union contracts,” Christie said. “And they may also have to consider service reductions or fare increases.”

Democrats are wheeling out disabled students in front of TV cameras saying that Gov. Christie is out to get them; the exact opposite is true. If the state goes belly up state services will come to a screeching halt. The unions have over reached, the nepotism, ghost employees, government jobs that pay three times the private sector equivalent, and other issues in New Jersey are no secret. This is what Christie was elected to do.

These are just the beginning helpful steps, what really needs to happens is that businessmen and investors need to have confidence and economic incentive to invest in New Jersey rather than China or Taiwan. The whole “demonize the rich and punish small and medium-sized businesses with crazy taxes” class envy nonsense that the left pushes is a one way ticket to the poor house.

The state employee union with the Democrats fixed it so for a $124,000 worker investment the state of New Jersey pays them over $3.8 million if they retire at age 49.

Leftist Ohio House Speaker Moves to Prevent Student Speech Award Because the Speech Was Pro-Life.

Columbus,OH — In what has been billed as an unprecedented act of partisanship, Ohio House Speaker Armond Budish is coming under fire for denying a pro-life teenager a chance to receive an award. Shelby County teen Elisabeth Trisler was hoping to receive a legislative honor routinely presented to others.

However, Budish is refusing to allow Trisler on the House floor to accept a legislative resolution.

The resolution, authored by Rep. John Adams, a Republican, honors her accomplishment as the National Right to Life Oratory Contest winner last year. (LifeNews.com editor Steven Ertelt was an officiating judge at the contest).

Such honorary resolutions are routinely presented at the start of Ohio House legislative sessions to constituents, including those who win athletic championships or academic contests.

But Trisler, whose winning speech received a standing ovation from several hundred people at the closing banquet, was denied the honor. instead, she will receive the resolution in the mail.

“Surely Speaker Budish can put aside his partisanship for 10 minutes to honor the accomplishments of a talented and optimistic teenage girl,” Ohio Right to Life Executive Director Mike Gonidakis told LifeNews.com today. “Perhaps his real message to Ohio’s teens is that excelling in public speaking isn’t worth being honored if their views are different than his.”

Muslim Student Association at U.C. Irvine Tries to Supress Free Speech

Antisemitism in action folks. Europeans have voiced concerns that their Muslim communities make no attempt to assimilate and deliberately try to balkanize European countries. Perhaps this is evidence of the same in the United States.

The Muslim Student Union at the University of California, Irvine sought to keep Israel’s Ambassador Michael Oren from speaking on campus last week.

The alliance between the hard left and Islamist radicals is a key element of the campus intifada. The group ActLeft has sent out an email to its Israel-Palestine action list requesting “urgent action” supporting the students who sought to prevent Oren from speaking.

This scenario replays the one involving Daniel Pipes’s appearance at UCI in January 2008. When Pipes spoke on campus on the threat to Israel’s existence, he was interrupted by students who were then removed from the audience like those who disrupted Oren’s speech. The students disrupting the Pipes event continued their protest outside, saying things such as “it’s just a matter of time before the state of Israel will be wiped off the face of the earth…just keep on doing what we are doing, our weapon, our jihad, our way of struggling. May Allah give them strength.”

The MSU is a chapter of the Muslim Student Association, which was itself founded by members of the Muslim Brotherhood. They seek the extinction of Israel. Resistance is required. If the spines of campus administrators need to be stiffened, it is not only supporters of the MSU from whom administrators should hear.

They’ve dubbed them ‘the Irvine 11’ in an attempt to make them heroes.” He writes about the efforts of CAIR and the NLG at Solomonia in “CAIR defends UC Irvine thugs.”

Mark Steyn points out that when Israel’s Deputy Foreign Minister tried to speak at Oxford yesterday, he was met with shouts of “slaughter the Jews.” Which, no doubt, is what the UCI “protesters” had in mind but weren’t quite honest enough to say.
