Koran burner Derek Fenton booted from his job at NJ Transit

Derek Fenton practiced his First Amendment rights by burning pages from a Koran and New Jersey fired him for it (LINK).
 
If memory serves I do believe it is section 1983 of the civil rights code that says if you act or conspire to violate someone’s constitutional rights you can be held civilly liable.

Every person who, under color of any statute, ordinance,
regulation, custom, or usage, of any State or Territory or the
District of Columbia, subjects, or causes to be subjected, any
citizen of the United States or other person within the
jurisdiction thereof to the deprivation of any rights, privileges,
or immunities secured by the Constitution and laws, shall be liable
to the party injured in an action at law, suit in equity, or other
proper proceeding for redress, except that in any action brought
against a judicial officer for an act or omission taken in such
officer’s judicial capacity, injunctive relief shall not be granted
unless a declaratory decree was violated or declaratory relief was
unavailable.
 
Translation, if Darek Fenton gets himself a good lawyer he will be a rich man. As I have stated before I do not like the idea of burning any book, but as an act of protest it is certainly constitutionally protected speech. Darek needs to go after the State of New Jersey as well as individually sue for damages anyone who participated in the decision to fire him. Make them pay and make an example out of them.

Christine O’Donnell Wins Delaware Senate Primary! Tea Party Beats Establishment Candidate Again!

The Tea Party is on a roll, defeating establishment liberal and/or big government Republicans in race after race ending the political careers of Charlie Crist, Lisa Murkowski, and Mike Castle. Crist, Castle, and Murkowski repeatedly violated the Republican brand and did not always govern as they campaigned, and now the citizens of their perspective states have made them pay the price. As a rule I do not like to comment on the looks of female candidates because doing so is sometimes sexist and unfair, but I must admit that her smile is infectious and her positions on the issues are admirable. O’Donnell is not perfect and she has made mistakes in her life. She is not a woman of wealth; in other words, like many Tea Party candidates she is a normal person who has had enough. We are not looking for saints to hold office, we are looking for people who govern smart, within the spirit of the law and recognize the limits of government power and their own office.  I am looking forward to see her performance as the Senator from the great State of Delaware.

Have women voters have had enough of the unfair personal and/or sexist attacks? I hope so.  Castle had a record he could not defend in a GOP primary. It was Castle’s to lose and he blew it by repeatedly violating the Republican brand. The GOP should have learned in 2006 and 2008, you cannot repeatedly violate your brand and expect to win.

Tonight is her night. Congratulations Christine!
